Terms of Service

1. The Service & Scope

Whose VR provides data enrichment services designed to assist professionals in the vacation rental and real estate industries. Users submit property identifiers (such as URLs, cities, or zip codes), and we utilize proprietary methods to identify associated property data, including owner contact information ("Deliverables").

2. Account Registration

• Eligibility: You must be at least 18 years of age to use the Service.
• Security: You are responsible for maintaining the confidentiality of your login credentials. You are responsible for all activities that occur under your account.
• Truthfulness: You agree to provide accurate information when registering.

3. Credits, Billing, and Payments

• Credit System: The Service operates on a credit-based system. Credits are a virtual currency used solely within the Service and have no monetary value outside of the Service.
• Purchases: Credits are purchased in advance. All fees are exclusive of taxes, which we will charge as applicable.
• Non-Refundable: All credit purchases are final and non-refundable. Credits cannot be exchanged for cash, transferred to other accounts, or refunded to your credit card, except where required by law.
• No Expiration: Purchased credits do not expire as long as your account remains active.
• Quotes: For certain orders, we will provide a Quote estimating the number of credits required. You must approve this Quote to proceed. Once approved, the estimated credits are deducted from your balance.
• Adjustments: If the final Deliverables contain fewer records than quoted, the difference in credits will be automatically returned to your Whose VR account balance.

4. Intellectual Property & Data Rights

• Whose VR Ownership: You acknowledge that the Service, the underlying technology, databases, and all data generated, compiled, or enriched by Whose VR (collectively, the "System Data") remain the exclusive property of Whose VR LLC.
• License to User: Upon your payment of credits, Whose VR grants you a limited, non-exclusive, non-transferable, revocable license to access, download, and use the Deliverables for your internal business purposes.
• Rights Reserved: This license does not convey title or ownership. Whose VR reserves the right to utilize the System Data and any data enriched through the Service for its own business purposes, including but not limited to database improvement, analytics, and service expansion.

5. Acceptable Use & Compliance

• Legitimate Use: You agree to use the Deliverables only for legitimate business purposes (e.g., real estate investment, property management).
• Prohibited Acts: You may not use the Service for:
  • Stalking, harassment, or threatening behavior.
  • Any purpose that violates the rights of others.
  • Reselling, sub-licensing, or redistributing the Deliverables effectively as a competitor to Whose VR.
• Legal Compliance: You are solely responsible for ensuring your use of the contact information (emails, phone numbers, addresses) complies with all applicable laws, including but not limited to the CAN-SPAM Act, the TCPA (Telephone Consumer Protection Act), and relevant privacy laws. Whose VR provides data "as-is" and assumes no liability for your communication with property owners.

6. Disclaimers & Limitations

• Data Accuracy: We use best-effort methods to enrich data. However, public records and third-party data sources may be incomplete or outdated. We do not guarantee 100% accuracy of the Deliverables.
• No Warranties: The Service is provided "AS IS" and "AS AVAILABLE." We disclaim all warranties, express or implied.
• Limitation of Liability: To the fullest extent permitted by law, Whose VR LLC shall not be liable for any indirect, incidental, or consequential damages. Our total liability for any claim arising out of these Terms shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

7. Termination

We reserve the right to suspend or terminate your account at our sole discretion if we suspect a violation of these Terms. In the event of termination for cause (e.g., violation of Acceptable Use), any unused credits in your account will be forfeited.

8. Governing Law

These Terms are governed by the laws of the State of New Mexico, without regard to its conflict of laws principles.
